A BILL
To require the Administrator of the United States Agency for International Development and the Secretary of Defense to give a preference for American companies in the award of contracts to provide assistance for Iraq, and to require the use of CDMA technology in any such contract for the provision of commercial mobile wireless communication service.


Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. PREFERENCE FOR AMERICAN COMPANIES IN THE AWARD OF CONTRACTS FOR ASSISTANCE FOR IRAQ.

In entering into contracts with private entities to provide assistance for Iraq, the Administrator of the United States Agency for International Development and the Secretary of Defense shall give preference, to the greatest extent practicable, to qualified American entities. Contracts for which this preference shall be given shall include contracts to carry out commercial mobile wireless communication service for Iraq.

SEC. 2. REQUIREMENT FOR USE OF CDMA TECHNOLOGY IN ANY CONTRACT FOR COMMERCIAL MOBILE WIRELESS COMMUNICATION SERVICE PROVIDED AS ASSISTANCE FOR IRAQ.

In entering into any contract with a private entity to provide commercial mobile wireless communication service as assistance for Iraq, the Administrator of the United States Agency for International Development and the Secretary of Defense shall require that CDMA technology be used for such communication service.

SEC. 3. DEFINITIONS.

In this Act:

(1) AMERICAN ENTITY- The term `American entity” means a company or other business entity that, as determined by the Administrator of the United States Agency for International Development or the Secretary of Defense, is a company or other business entity the majority ownership or control of which is by United States citizens.

(2) COMMERCIAL MOBILE WIRELESS COMMUNICATION SERVICE- The term `commercial mobile wireless communication service” means any radio communication service carried on between mobile stations or receivers and land stations, and by mobile stations communicating among themselves, that is provided for profit and makes service available (A) to the public or (B) to such classes of eligible users as to be effectively available to a substantial portion of the public.

(3) CDMA TECHNOLOGY- The term `CDMA technology” means code division multiple access technology.
